Terms of Use

These Terms of Use (hereinafter referred to as "these Terms") are commonly applied when users, as defined in Article 1 (hereinafter referred to as "Users"), use various services (hereinafter referred to as "the Services") provided by the General Incorporated Association Ayumi (hereinafter referred to as "the Association") through websites, etc.

Article 1 (Users)

Users are individuals, corporations, or other entities who have read and agreed to these Terms.

Article 2 (Prohibited Acts)

The Association prohibits Users from engaging in the following acts when using the Services:

(1) Acts that violate laws, these Terms, or public order and morals
(2) Acts related to criminal activities
(3) Acts that destroy or interfere with the functions of the Association's servers or networks, or acts that may interfere with the operation of the Association's services
(4) Acts of transmitting or posting harmful computer programs such as viruses
(5) Acts of collecting or accumulating personal information, etc., related to other Users
(6) Acts of impersonating other Users to use the Services
(7) Acts of providing benefits to anti-social forces directly or indirectly in connection with the Association's services
(8) Other acts that the Association deems inappropriate
(9) Acts that infringe or may infringe on the property or privacy of the Association or third parties
(10) Acts that cause or may cause disadvantage or damage to the Association or third parties
(11) Acts for business activities or for the purpose of profit, or acts for the purpose of preparation for such activities

If the Association discovers any of the above prohibited acts, it may delete all or part of them without prior notice to the User, but it is not obligated to constantly monitor the site.

Article 3 (Usage Restrictions)

1. The Association may restrict the use of all or part of the Services for Users without prior notice if the User falls under any of the following items:

(1) If the User violates any provision of these Terms
(2) If the Association deems the User inappropriate for any other reason

2. The Association shall not be liable for any damages incurred by the User due to actions taken by the Association based on this Article.

Article 4 (Copyright)

1. Copyright and other rights related to the information posted on the Services belong to the Association or the rights holders who have granted permission to the Association, and unauthorized use (including reproduction, alteration, distribution, etc.) beyond the scope permitted by law, such as for private use, is not allowed.

2. The Association may freely use and reuse information posted by Users on bulletin boards and information provided to the Association in responses to surveys, etc., excluding personal information, without notifying the User in advance.

3. Trademarks (trademarks, service marks) used in the Services belong to the Association or the rights holders who have granted permission to the Association, and unauthorized use is not allowed.

Article 5 (Disclaimer)

1. The Association shall be exempt from liability for any responsibility to Users regarding the Services unless due to the Association's intentional or gross negligence.

2. Even if the Association is liable for any reason, it shall only be liable for compensation within the scope of damages that usually occur.

3. The Association shall not be liable for any transactions, damages, communications, disputes, etc., that occur between Users and other Users or third parties regarding the Services.

4. The Association carefully creates and manages all information posted on the Services but does not guarantee its accuracy or completeness.

5. The Association may suspend or discontinue the operation of the Services or change all or part of the information posted on the Services without notice.

6. The Association shall not be liable for any damages incurred by Users due to the use of the Services or inability to use them for any reason, or for any damages caused by third-party data writing, unauthorized access, statements, email transmissions, etc.

Article 6 (Notification or Communication)

1. Notifications or communications between Users and the Association shall be made by posting on the Services or by email, etc., as deemed appropriate by the Association.

2. Notifications or communications made by the method specified in the preceding paragraph shall take effect from the time they are posted on the Services or sent by email.

Article 7 (Changes to Service Content, etc.)

The Association may change the content of the Services or discontinue the provision of the Services without prior notice to Users and shall not be liable for any damages incurred by Users as a result.

Article 8 (Suspension of Service Provision, etc.)

1. The Association may suspend or interrupt the provision of all or part of the Services without prior notice to Users if it determines that any of the following reasons exist:

(1) When performing maintenance or updates on the computer system related to the Services
(2) When it becomes difficult to provide the Services due to force majeure such as fire, power outage, or natural disasters
(3) When the computer or communication lines are stopped due to an accident
(4) When the Association determines that it is difficult to provide the Services

2. The Association shall not be liable for any disadvantages or damages incurred by Users or third parties due to the suspension or interruption of the provision of the Services.

Article 9 (Changes to Terms of Use)

The Association may add, change, or delete these Terms by notifying Users without obtaining their consent if deemed necessary.

Article 10 (Handling of Personal Information)

The Association shall make efforts to properly handle Users' personal information in accordance with the Privacy Policy.

Article 11 (Recommended Environment)

1. It is recommended to use the following environments when viewing the Services.

2. When using the Services, it is assumed that Cookies are allowed.

Article 12 (Link Sites)

The Association shall not be liable for any content of third-party websites linked from or to the Services or for any damages arising from the use of such link sites.

Article 13 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer or provide as collateral their status under these Terms, or rights or obligations based on these Terms, to third parties without the prior written consent of the Association.

Article 14 (Governing Law and Jurisdiction)

1. The governing law for these Terms shall be Japanese law.

2. Any disputes regarding these Terms and the Services shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Association's head office as the court of first instance.
